Police Records Requests
How to obtain a police report or other police data:
To obtain a copy of a police report or other police data, follow one of the options below.
Important information about your request:
° The information you provide is subject to open records laws and is classified as public. The information that you are asked to provide on the request form will be used to process your request. You are not legally required to provide this information, but we may not be able to process your request without it.
° If requesting private data about you or your minor child(ren), you may also need to submit a copy of a valid state ID, driver's license, military ID or passport.
° There is a charge for copies. You may be required to pay for copies before the records are released.
° If you seek to inspect records without charge, arrangements will be made to permit records inspection during normal business hours.
° The St. Croix Falls Police Department cannot require you to provide identifying information when making your request but if you do not provide a way to reach you, we cannot ask any follow-up questions about your request or let you know when it is ready.
° If requesting private data about you or your minor child(ren), you may also need to submit a copy of a valid state ID, driver's license, military ID or passport. Juvenile information, as well as personally identifiable information as defined in the Driver’s Privacy Protection Act in 18 U.S.C. § 2725(3), will be redacted from all reports unless exempted under 18 U.S.C. sec. 2721. It is a crime for any person knowingly to obtain, to make false representation to obtain, or disclose information from a Wisconsin Department of Transportation record under the DPPA.
º The City of St. Croix Falls Police Department charges redaction fees to records requesters when permitted by law. The redaction fees shall be reasonable and shall not exceed the actual, necessary, and direct cost of the redaction time. The redaction fee shall be based on the pay rate of the City's lowest-paid employee capable of performing the task. The lowest-paid employee capable of performing the task will vary based on the source of the record, the content of the record, the capability and skills of operating equipment to perform the redactions and other legitimate factors. The Department will not fulfill the request for records involving recorded audio and video content until the estimate of costs identified in the written fee estimate is paid by the requester.
º The requester is responsible for providing sufficient information for the records custodian to determine whether an exception under Wis. Stat 19.35(3)(h) prohibits the Department from charging redaction fees.
º Wis. Stat. 19.35(3)(h)3a specifically provides:
3. An authority may not impose the fee under subd. 2. with respect to a request for records containing audio or video content for which all of the following apply:
a. If the requester is an individual, the requester provides written certification to the authority that the requester will not use the audio or video content for financial gain, not including an award of damages in a civil action. Any individual providing false certification under this subd. 3. a. shall be subject to a forfeiture of $10,000 for each violation.
In-person Requests
We have data request forms at our front counter for those that want to submit them in-person. They can be submitted during normal business hours (M-F 8 a.m. - 4:30 p.m.).
° There is a charge for copies, and you may be required to pay before the data is released.
° The St. Croix Falls Police Department has a reasonable amount of time to provide the information you are requesting. In most cases, we will respond to your request within 10-business days from the date the request was received.
